Current Litigation

I was going to post a reply, but its probably not a good idea to criticize the judge at all...

I don't think it was criticism.. just my opinion based on that article. Although I do agree with you if it was bashing or belittling of him.. but it wasn't. Judges are used to people not liking their decisions or opinion. It's part of their job.

On a side note though.. Does anyone else find it hard to believe that there are only 130,000 licenses of vB?

The funny part about all this is the fact that vB 3 owners not doing business with IB has absolutely nothing to do with the development of Xenforo, but it is all due to the fraudulent licensing changes enacted by Bob Brisco and Ray Morgan.

In addition, the claim in the lawsuit that Internet Brands owns Xenforo software is laughable, I think the jury will agree with both of my statements in this post since there is plenty of evidence in the public domain as well as in the coding of XF software that there is no duplication of code and that means there is no copyright infringement.

Here is what XenForo is compared to vB4. (someone I know is going to call me a fanboy) It is hope, it is what I think we need to save us from forum software Hell...

The XenForo team save us from that evil forum company that don't care about their customers. Win this lawsuit. We need software hero's.

Internet Brands would like spin it this way. I compare the situation to a rose. To a jury, if it looks like a rose, smells like a rose, to the jury it is a rose, even though the fact is that it is a cloth rose, which Internet brands conveniently forgets to mention.

Yep....it is sad.

Yeah, if you do not have to deal with a stupid ignorant jury that is easily playable by crafty lawyers. Which unfortunately happens all the time.

LOL, Brisco trying to blame Kier for the Titanic disaster he made out of the vBulletin acquisition is simply a cover up for his own failures, it is no wonder Bill Gross wants to sell Internet Brands ASAP, I certainly hope the venture capital fund (private equity investment bankers) pull out and leave Brisco in the outer darkness where he really belongs.

Elizabeth - Looks like that query timed out.

Here's the judge himself. Really doesn't look 85, IMO.

If he's like my dad who is about the same age, he knows zip about the internet. My dad is a smart man, it's just computer technology is beyond him. Freecell is about all a computer is good for in his opinion.

That can be an advantage if the judge doesn't know much about the internet/ICT. If it's a good judge he will then try to look for good expertise and take more time to learn about the facts.

I don't know if this is a similar reason, but this article didn't give me the warm and fuzzy about this judge.

No judge is going to stop doing their job due to sympathetic reasons... otherwise they wouldn't be a judge any longer. Sympathy and judge don't equate... hence why jury's exist, being the human component without the law degree, that get to apply the law + commonsense + humanity as required.
