Not everyone is worried about the so called GDPR compliance, would Not be fair to them to have to pay extra for something they do not need.
It's your responsibility to ensure your site is compliant to your laws, even if that means purchasing additions to the addon.
Dear Ozzy47,
I know that you are not a fan of the
GDPR. We both had already several discussion about it since the introduction of the GDPR in May 2018.
It is your decison if you do not care to comply with the law, but everyone else who has even only one European user on his mailig list or in his forum, has by law to be compliant with the GDPR. I doubt that there even exist an English speaking forum in which no European user exist.
Again, it is your decision if you are willing to break the law. I do not mind. I am not responsible for your actions.
But for someone who is living from selling addons, this is very important since it reduces the potential market to sell his products significantly. Just because the inside of the newsletter branding free option makes this product too expensive for many admins.
This is the first I'm hearing of this, would you be able to link me to the specific section so I could look into this further?
I have no specific text link which describes this specific situation. As always the text of laws is always written in a way, that they have enough room to interprete it the way they want it to - or at least lawyers try it.
The key criteria is, what a user expects to get when he subscribes to a newsletter. If he subscribes for a newsletter to get the latest deals on smartphones and accessories, than this is an advertising newsletter and he knows what to expect. So in this case, your advertiser link within the newsletter my not cause problems, although it has nothing to do with smartphones and you are based outside of Europe (afaik), so take this with a grain of salt.
But if you have a newsletter for i.e. a diving community forum and as an admin you do not write that this newsletter contains advertisement, the admin will get a problem as soon as a user complains and send this to the authorities
Because the user does not get what he expected to get/ what I promised him to get and this is something the authorities really do not like in Europe. Even worse, if the advertiser in that newsletter is sitting outside of Europe or has his server outside of Europe. You need basically for everything a written consent of the user beforehand.
I know this sound extreme. But it is better to be on the safe side and do not give anybody a reason to try to make some money here, just because I was too lazy and did not pay attention to what my users receive in my newsletters.
Lawyers love GDPR. It is a gold mine.
