Right, but you clearly stated in your previous post that "When iB acquired vBulletin, Darby was still developing vb4", which is incorrect. vBulletin 4 development began around a year after the acquisition.

He can do what he wants. The resignation only covers the termination of employment and nothing else. BUT, they make you sign a non-compete contract before resigning. That non-compete does not cover the whole "talking to other employees."

I read the contract, it says NOTHING about not talking to employees, staff, etc.

The trade restriction contract, or Restrictive Covanent Agreement was signed along with the employment contract.
 
In the US legal system, the burden of proof rests with the plantif and the evidenciary standard is a preponderance of the evidence. They have to provide that it is more probable that xenForo is based on vB than a completely new product. It must outweigh the benefit of the assumption of innocence.

As a programmer and IT professional, I can see the truth as plain as day. The problem is a judge doesn't have my 27 years of experience.

They could however call you as an expert witness :D
 
When I took a photo that included that particular whiteboard, I was accused over a year later of stealing trade secrets. I hope that whoever took this photo has their ass covered.
If we can read what's on the board (oddly, the fact that it was made public is just hilarious when there's supposed to be secrets there) and implement them in our code... is IB going to come after us too?
