Lying about what? I'm sure he did go around and talk to Jelsoft staff. He already knew most of them. He was visiting from UK. It's always nice to put a face with a name on the ones he didn't already know. I know I would. So on that, I'm sure they're not lying, he probably did go around and chat it up.

That Kier stole their plans, ideas, and intent, while he was employed with Jelsoft. They've already stated that.
That XenForo is stolen code from vBulletin, and that is the ONLY reason he was able to produce XenForo so quickly. From stolen code.
Sweetheart. I know that. But, what I meant is that - they're going to confuse Darby's visits to iB headquarters with the assumption that HE stole iB's plans, ideas, and intent... along with the vB code.

When iB acquired vBulletin, Darby was still developing vb4, and shortly afterwards, he resigned. That's what I remember. Now, from what I read, THEY [iB] are accusing Darby of trade-secrets just because he was talking to vB staff after resigning.

When you're developing something new, and something that was supposed to be released - such as vb4, you already know the code. Once again, iB is going to confuse things with another situation.

Knowing the vb or vb4 code by the back of your head is irrelevant; so I'm guessing the whole stolen code situation will just get thrown out.

He can do what he wants. The resignation only covers the termination of employment and nothing else. BUT, they make you sign a non-compete contract before resigning. That non-compete does not cover the whole "talking to other employees."

I read the contract, it says NOTHING about not talking to employees, staff, etc.

No, that's not true at all.
  1. When Internet Brands acquired Jelsoft, we had just finished vBulletin 3.6. vBulletin 4 was not being developed at that time.
  2. I didn't resign until nearly two years after the acquisition, I'm sure that does not qualify as 'shortly afterwards.'
  3. Nobody is accusing me of talking to vB staff after resigning, they are accusing me of talking to vB staff when I was in Los Angeles, at which point I was vBulletin's lead developer. That's what makes the accusation so ridiculous.
 
When I took a photo that included that particular whiteboard, I was accused over a year later of stealing trade secrets. I hope that whoever took this photo has their ass covered.
I didn't even realize the whiteboard behind the fashion statement.

No... that would only be absurd. Ridiculous is claiming somebody "stole" something after they also allege deliberately giving that same person the keys to access every room in the castle.
 
In the English action, they have retained the services of DLA Piper.

None of these firms come cheap. Not by a long shot.
An expensive law firm is only as good as their client's legal claim, so at least they'll be spending a small fortune on this pointless expedition (speaking from experience of having gone up against them and won). It's a shame I don't know anyone in the English offices of DLA Piper - could have found out how good their team is there!

Well, in the court papers, and previous schema tells me that you worked the early stages of vb4 - at that time, it was a time that you felt that the management at iB wasn't perfect, and so, you decided "that's it, I'm resigning." I read a lot of vb4 discussion in both your declaration, and iB's own, so I assumed in the grand scheme of things, you worked on the vb4 project for some time before resigning. Of course, it does not have to be 'coding' and 'developing' the code immediately, but you had plans for the re-write, and you shared a [at least a] little tidbit of code. So, at this point, from my perspective, you worked on vb4 - and in my opinion, the "new" vb4 code is yours. If I was the judge, I would void that argument iB is making.

And yes, that is ridiculous of accusing you of talking to vb staff while in los angeles.
