Me personally, I wouldn't even bother to attend or fight it in another country... what are they really going to do at the end of the day? Just don't go back to the US ever. I would just continue with the UK one personally.
 
I'm not following you 100% Michael. IB's justification for California jurisdiction seems pretty ridiculous to anyone who understands technology, right? Lets assume Judge Real doesn't and can't see that its dubious reasoning and in his mind believes IB has standing and that his court is the proper venue. Then the case in UK not withstanding, he would likely not dismiss.

At any rate, I think we both agree that this has nothing to do with the merits of the case and shouldn't chase anyone off from using xenForo. This is little more that legal foreplay, although admittedly not as enjoyable as the more traditional variety.
 
This is legal foreplay that it would seem should have been stopped before being prolonged and marching towards what some might consider abusive. Costly and unnecessary. Still, I'm waiting to read the justification for this ruling because I can't quite come up with one as of yet.

Minor speed bump in the smooth road that's to come ahead hopefully :). I think the best thing we can do now is let this run it's course, and keep those modifications, styles and resources coming to produce some more business for KMA :).
 
Okay, so what's the "positive" in this .... the positive is that xF is still open for business and able to sell licenses. It's still able to develop its software, increase its customer base, and generate further revenue to spend on legal fees!!!

So, forget the denial to dismiss, and think about all the lovely lolly that xF can take at the till between now and the next court action!!! :)

Same here. I'm studying law at the moment, but my knowledge is still limited. It will be interesting to see what the justification for refusing to dismiss is. I thought for sure, if nothing else, the case would be dismissed because of the parallel UK case.

Really bummed about the hearing. I know I shouldn't say this, but this would have never happened in a UK court, where this should be played out!

Guys, can we not attack the judge. Doing so may cause more harm than any good (or lack of) whatsoever.
