What the hell? I can't wait to hear the Judge's reasoning. Still, its only the first step, this is far from lost, remember it was only a hearing to decide whether the case would be thrown out or not. Obviously the judge thinks its worth carrying on, possibly to a full trial.

There is nothing to say that it won't get dismissed further down the legal route. We have to remain positive. Given the technical nature of the case, perhaps we shouldn't be surprised that the Judge wants a trial. I'm sure Kier will fill us in when he can.

I wouldn't so much blame the law but look at the judge.

to be fair, we need to wait to digest the ruling. All we know is that the motions to dismiss failed, , we don't know why yet. Although god knows how the 2nd one failed, that was pretty bloody obvious! The UK suit was initiated before the California suit.
 
I agree with Brogan. Like everyone else, I am shocked and speechless, but this is NOT the end by any means. It just means that the judge does not want the case dismissed (for yet unknown reasons).

So let's not lose our hopes right away. :)

Kier, Mike and Ashley...I really hope you guys are sleeping and resting after such a long day, as hard as that may sound. Rest well and I'm sure that you guys will figure some way out. As ALWAYS, you have all our support with you. So keep those chins high! :)
 
Can we lay off the Judge please, criticising or lambasting him isn't going to help anyone at the moment. Besides, he may well have had to deny them because of legal issues we don't know about yet. Speculating or criticising the judge isn't going to get any answers. We just have to wait.

Honestly, folks, don't get too spun up about this. Its hard to imagine a judge of his age having a firm grasp on the finer points of the technology involved. I'm sure all of us have at least one niche interest were we have very deep understanding of the subject. When we discuss it with others of a similar background, we can cause the eyes of observers to glaze over as though we are speaking Greek.

I'm willing to give the judge the benefit of the doubt, believing that he didn't have enough understanding to reach a conclusion. if that is the case, he should err on the side of caution and adhere to the principle that everyone is entitled to their day in court.

I honestly don't believe this is any reflection on the merits or specifics of the case. I'm failrly sure Judge Gates or Judge Jobs would have sent this one packing. I'm 100% certain Judge Zuckerberg would have!

Its was only a preliminary motion to dismiss, in the grand scheme of things its just a speed bump on the road through the court system.

Do you have court papers? I have not been informed that it will start next year.
