Is that really necessary?

You do realise it's the weekend right?
Today is the weekend, his last post was made 4 days ago. Although, I should have check "last seen online" as well (my bad).
And I'm not complaining here, just wondering about the future. Haven't heard anything from him about it, that's why.

Well give him slack ! I guess he clearly mentioned he got some personal issues .....so personal life comes first even tho he is dealing with legal issues as well .

I tell you what I think. I think the !§$%$% lawsuit is putting Kier & co in the predicament of not being able to pay any salary to their employees and/or to themselves.
Kier, has more or less confirmed that's the case in his first post in this text quoted below from it.

"It's a great pity that Mike, Ashley and I have been unable to really celebrate that success due to the dark shadow of the ongoing lawsuits hanging over us and the grotesque cost of mounting a defence against them, which has meant that virtually every penny that XenForo has made has been consumed by legal fees rather than paying us a salary or allowing us to hire more staff to develop our products faster. "

I have been in this boat myself, working for a company that was unable to pay salaries for many months in a row. It was dragging and depressing, and ultimately, even the most loyal employees left because they needed money to live and support their families. Like I said, this is just what I am thinking and I could be very wrong. But it all looks so similar (the sudden disappearance of key people, the sad but honest voice of their leader, etc.).
There's only Mike and Kier as the two main developers. Kier is still around of course posting this thread, and so I'd say is Mike. Ashley who deals with the business side of things, he's been seen around, so have all the moderators now. I don't think people on the team have left to other jobs, some of them just don't seem as active online anymore, not like we got used to seeing them here before.

They're probably working trying to finalize the release of the "Resource Manager and XenForo 1.2" together. Just my view, but I don't think we'll see the Resource Manager put up for sale until XenForo 1.2 is finished and released as Beta or what-ever version.

If "virtually every penny that XenForo has made has been consumed by legal fees", then I can definitely see them having to have other jobs to support their families. They still have to pay their own bills and buy food for their families. So, I can absolutely see that as part of the reason why they are "disappearing" from time to time.

I can tell you that it takes very strong and focused individuals to be able to put forth a great product and balancing their 'home life' when you are spending every penny on legal fees and not seeing any fruits of your labor.

Once K.M.A. make it past the lawsuits (hopefully sooner than later), then it will be great for them.

Until then... keep your heads up boys! :D

Hello back, Kier!

Speaking of Mike. When was the last time you heard from him?

I talk to Mike almost daily off-xenforo.

It's probably best to just leave the XF team alone for a little while now; let them sort things out and not put any more pressure on them than they have already!!

I'm sure when there's some product news to deliver we'll be the first to hear about it ... :D

Cheers,
Shaun :D

I find it absolutely disgusting that a company can essentially be ruined just by suing them, which in and on itself does not prove or disprove anything, you can sue anyone for anything, regardless of whether you intend to win.

Seriously hope they win this lawsuit and that every single penny is repaid. Any judge would be an idiot not to recognize that the whole thing is frivolous. Sadly there seem to be plenty of idiot lawmen out there.

Thanks for the update, Kier.

I know is not easy when you deal with personal issues or lawsuits... but I was hoping you or Mike would make an announcement related to Xenforo development also. I think the community is anxious to learn at what stage the development of Xenforo 1.2.0 (and other related products) is.

This is actually extremely rare - and, just guessing here, may be more related to the lack of proper moves on the part of the XF legal team.

The courts usually keep in mind the fragility of small business v bigger ones. Also, there are strategies which smaller companies can use to fight - especially the court of public opinion:

Of course, these are not the domain of software developers.....which is why, if it were me, I'd have been running to the EFF and every other available "internet freedom" group from day one.

If pressure, in the form of bad PR and lost sales, can be brought against IB.....in a coordinated fashion, they are very likely to settle or give up. Again, all complete speculation, but maybe arbitration can work. IB has a good product and, if they have sane decision makers, why wouldn't they want to do away with the bad blood this is causing and more on to more sales and profits?

Sometimes, though, companies and individuals get a "bone up their arse" in course language...and do things against their own interests. But I find that to be the exception rather than the rule.
