But please keep in mind folks that the hearing is not scheduled for 10am PST. It is scheduled for the 10am session. There could be 2 or 3 or several, cases being heard during this block of time. We may not hear anything til way later in the day. Even worse for K/A/M - later in the night!

I'll sum them up for you very succinctly.

1) Do XenForo or I maintain a presence in California, or especially target California in any of our actions?
If 'no', dismiss the case for lack of personal jurisdiction.

2) Has a case alleging the same wrongdoing and seeking the same remedy already been filed elsewhere?
If 'yes', dismiss the case for forum non conveniens.

Those are the only things being decided tomorrow.

Based upon those two items, I can't see how the California hearing can fail to get dismissed, to be honest.
