I have been cleared to inform on the subject-matter earlier.

Both Plaintiff and Defendant have agreed to stay in court pending the outcome of the US Court, i.e no progress will be made in the case in the UK until the US case is closed.
Good, at least efforts can be focused on one case at a time then.

So is this saying XenForo have agreed terms to see the US court trial out till the very end, "they've agreed they won't drop out for whatever reason, such as making yourself bankrupt". And in return IB have promised they won't start a second UK court trial at the same time running alongside it in return for XenForo agreeing to do that?

In other words, they are offering to make things more easy for XenForo financially, but only if they agree to see the US trial out till the very end result is given to either party. Don't see the big deal why Shamil held this back for?

OK, would be hard to do such a thing anyway. I mean, if you was in a situation financially having no choice for example but to make yourself bankrupt. You just couldn't keep to it.
 
It's obvious to everyone that this court case has been a massive own goal by vBulletin. Their own expert testified against them saying that there was no evidence of vB code being used in XenForo so the case will be hard to prove for them.

But putting all the specifics aside for a moment, why tell the whole world of XenForo's existence as soon as they launch? By taking out a lawsuit against XF they immediately told all their customers and all 'aware' customers of any forum software that XenForo existed!

KAM needn't have spent a dime on advertising because IB did their marketing for them.

I'm guessing IB will attempt to match Xenforo customers and vBulletin customers by claiming that X% of XenForo customers are also vB customers and that that proves XF misappropriated customer lists. If that does happen I hope XF lawyers will have considered the possibility that those customers could just have easily heard about XF though the IB lawusit (openly discussed on vB, XF and most admin forums). The existence of the lawsuit alone would expose almost all vB customers to XenForo and I doubt KAM could have had as extensive a customer list as that to work from anyway!
 
I don't see what knowing who was a customer of vb would matter anyways....I don't remember ever receiving an email from Kier, Mike, Ashley or anyone else otherwise saying 'hey try this new software out'....I heard about xf on the internet like everyone else for the most part and was in from the beta...never had to second guess that decision.

I read about it in the licensed customers forum on vB.com. Never was mailed or approached by anyone from XF Ltd, but already was looking to switch away from vB4. Reason? vB4 was a pile of ****e, and even now in 2012, IB has not delievered what was promised back in Nov. 2009.

I'd have switched away even if there had not been a XenForo, and I'd happily terstify that in court.

I had frustration after frustration with every vb4 release. I felt totally trapped on 3.8 with no upgrade path. I very very nearly went to IPB.... not sure how that would have worked out.
 
The customer list thing would seem really hard to prove! If true, it would be gross stupidity on the part of folks who I don't think are stupid.....

I found XF just with some basic google queries. ANYONE looking for new forum software from 2010 onward would have found it with one or two queries.

Back in the old pre-internet days, taking customer lists was a real coup (sometimes illegal, of course!)....but in today's world, it does not matter in most industries because Goog has leveled the playing field.
 
I found XenForo because news of Internet Brands Inc deciding to sue some unknown company called XenForo Ltd, made me wonder what all the fuss was about.

Internet Brands Inc and / or vBulletin (technically same thing) are their own worse enemy. They basically promoted XenForo Ltd with free advertisement with publicity.

I got a hold of a copy of the 1st beta and of course the current versions. And there is no code from vBulletin past or current.
 
I was very furious about the licencing price vBulletin set and wasn't convinced & motivated to upgrade to the VB4 series. My admin friends had all sorts of problems after their upgrade, some of them downgrated after a while. I was already concidering to change the forum software, I knew IPB but have recenlty read about XenForo being developed on a vBulletin admin community. I guess the last straw was my forum being hacked (due to an exploit in the software) and we decited to go with XenForo in the early stages. Never been happier.

Even if they did get a %, that doesn't mean anything. I was baited by the whole "buy now without seeing the final product and you won't pay the full amount when it's actually out". I ended up weighing vb4 with IPB at the time and decided to switch. Bad decision when looking back, I should have just stayed on vb3 had I known xf was coming out. You'd have to look at how many people switched to a different software and then switched to XF. That would give you a good idea of the failure of vb4 and putting the blame on IB for doing a crap job. Also looking at the percentage that have a vb4 license but have continued to stay on vb3.

There are too many factors to think about and I don't think they'd like the results they find if they actually dig deeper into the demise of their product.
