Opinion: Is spam freedom of speech?

There is no freedom of speech on a privately owned website. You are not obligated to spread someone's ideas for them regardless of what they are (spam or anything else).

It reminds me of one of the funniest spammers I ever had though... a guy from China actually took the trouble to contact me after I deleted his spam. He said he was going to report me to the FBI for taking away his freedom of speech (his spam was just the normal stuff like slinging fake imitation purses or something). The most ironic thing about it is the guy is in China. Do they even *have* freedom of speech of any sort over there?

Question:

Do you believe spam counts as freedom of speech?

I am a strong follower of the US Constitution, and the 1st Amendment, but with freedom of speech comes a couple of things. A person's right to NOT listen to or read it (hence the ability to delete, and/or ban someone or something), and consequences.

Right.
We all have a right to free speech, freedom of expression, to think freely. That right is not granted in the US via the Constitution. It is granted at our Creation, and the Constitution only requires the government to protect those basic human rights.
If other countries choose to not protect basic human rights for their citizens in their governing documents, that does not mean that those rights do not exist. It just means that those rights are unprotected.

But, NO ONE has the right to expect their free speech to be presented or recorded in any channel or venue and no right to be heard.

Very well said!

If something is identified as spam, that means it's a violation of individual rights. The owner of private property (website, mailbox) has the right to decide what content to allow. Freedom of speech just means that people can say what they want, as long as the rights of other individuals are not violated.
