I would like to see who they drag into this lawsuit.....

More than likely they are going to drag everyone under the sun and point the blame on everyone other than themselves.

XENFORO LIMITED, a United ) Kingdom entity; KIER DARBY, an ) individual; MICHAEL SULLIVAN, ) an individual; ASHLEY BUSBY, an ) individual; DARREN GORDON, an ) individual; COLIN FREI, an ) individual; and MERT ) GOKCEIMAM, an individual.

Here's the thing vB doesn't get. I was not drawn away from vB by XenForo. I was driven away to XenForo by vB 4. Had XenForo not existed - had KMA not made this software - I'd still be using a different platform!!

This is my own personal opinion and story, but the quality of product I paid for just was not there. So I went elsewhere. No matter the outcome of the case, I'm not going back. And it's not because I'm mad that they are doing this but because I don't like their product.

Argh!

I have been wanting this to end for such a long time:cry:

It would be cool if like 1000 well dressed very polite acting XenForo fans showed up to witness the trail.

Guys, just ignore this; it is all short-term noise. IB is in a much more compromising position than XenForo Ltd.. A large number of IB's communities are run on vBulletin. When the demand explosion occurs and the masses flock to xenForo, communities that run xenForo will have a competitive advantage versus those who do not.

I believe IB will be in the position where they can only [try to] mend whatever customer relationships they can and innovate vB in an exponential manner (which will require additional staff in the face of plummeting vB sales). If they cannot do that, which is the likely case, the massive supply of second-hand vB licenses (= less first-hand sales), tales of XenForo's victory, and IB's communities losing their edge + revenue to modern xF ones will start a panic among INET investors. Then, Hellman and Friedman puts IB out for sale super-cheap. :)

Regardless of this, they are in a stronger financial position - and sometimes that's all you need. They don't have to win, just keep the game going until XenForo can no longer afford to play.

Bottom line is they have a lot more to lose financially. I wouldn't be surprised if H&F is trying to find a sucker to buy IB right now; the series of lawsuits is the only thing keeping IB from spiraling downwards.

PS: On my enough rope working hypothesis...

If this motion had been denied, it may have given IB a basis for appeal, regardless of outcome, thus protracting all of this litigation way further down the line (mo' $$$$ out of pockets of KMA).

By granting this motion, it seems to me that the Judge may have just eliminated such basis.
