California Case Update

As far as public forums go, you can always use the WayBack Machine at archive.org. If it was publicly accessible at some point, you might be able to find it unless they requested its removal or blocked the site from archives. It's slow, though. There also appears to be no data from 2011- I wonder if that is on purpose.

No need to even do that, XF could issue a subpoena for the information and if it was deleted from the DB and no archives are available, it would look poorly on the IB team.

But if the data is not there, how can you prove anything? You can claim all you want, but without the proper evidence their is no way that would fly.

An affidavit from all would be enough, but it does have a cost to it. I have stated before in this thread that I never new of XenForo and was leaning toward Expression Engine or free forums, until about 10 months ago.

This is not the major part of the case and they just want to prove that XenForo was create during employment, as making a competing product within whatever time frame does not give a former employer the right take work done by ex-employees. If you are not getting any regular checks, then how can anyone be in breach of these types of contracts. Your not allowed to create anything or is it not allowed to earn until whatever time frame.

A non-compete clause is generally ignored in California.

There is other supporting evidence to back up the xF case. The Register has been covering the vb4 debacle quite closely, and there are other threads on sites outside of the vb domains that back up this particular argument.

For example: http://www.theregister.co.uk/2009/10/28/vbulletin_controversy/ and http://www.forumpostersunion.com/showthread.php?t=8864

I wanted to buy IPB a month ago, then I said forget it cause the staff would not let me download the 2.x series with a 3.x series license. They do not believe letting customers download archived products that are no longer supported. I know what I am doing, let me make my own decisions and then upgrade to latest with my own license when I want to.
You do, loads of people don't. They install older versions, something doesn't quite work, come asking for support, none is given because it's not supported anymore, and suddenly they are the bad guys for not supporting unsupported software. Oh well.

Internet brands is really smart on the pricing scheme by-the-way. vBulletin 5 should be out by the holiday season or first quarter of 2012, according to their pricing scheme.

Dunno if quoting AnthonyCea is the best idea though.

I do however still remember the whole pricing change and the reactions on it.

True, but the comments section on the register articles are a far better indicator, as a fair proportion of them are from VB licence holders (myself included).

It shows that there was smoke for a long time before IB claimed xF lit the fire...

I agree, you get the entire story on Xenforo and vB, plus you would not want to upset the wanna be mod squad here lead by stealth moderator and Xenforo editorial director Shelly !!!

I am sorry but what is wrong with you? The staff here is excellent. I assume the wanna be mod squad are the enthusiastic members out here, they seem to overall be a great bunch of people. You singled out Shelley by name, I don't see anything wrong with her, I love the work she has done.

I left vB when they come out with 4 and changed the user agreement. Like many, I converted to IPB. After a while I felt that IPB didn't quite fit my needs so I waited for xF to come of age. I recently converted my IPB site, with over 100,00 posts and 1800 members, to xF.

My members like it and I like it.

I think the fact you are still on here shows the amount of patience the Owners and Staff is capable of. Calling out Shelley by name was a bit tasteless as well the other "wanna be" mods where not singled out.

There are ways of debating or having a difference of opinion without making it a personal attack. I am unhappy with vB as you are but I don't understand how lashing out at XenForo members helps your cause.

He is just a troll from another block who is in search of life & light . So "ignore" him & wait to see this post from his "another wannaba mod".

I quoted the wrong post. My bad
Ah! come on, this thread was getting good. I had to search for both of you in over at vB to see the history. Then I came back to find out you made a slight error. :)

I was thinking that this is going to take a bad turn in this thread, but it still the same person that I think you want to quote.

I got to get back to working on my site, as this thread has got a grip on me right now....:D
