California Case Update

I doubt courts do anything without getting paid. Why would they have the interest if there's no paycheck?

I was thinking as part of the current case. It can show how IB's has not behaved that well and might help XenForo's case if they saw what has happened in the hidden owners area.

Customer satisfaction will never be an issue, unless evidence/documentation is provided/submitted to the court.

IB is fishing with sales data, not customer posts.

Were customers able to purchase vb4 while in beta? I don't remember.

Yup. From vB4.0 until vB 4.05 or so :D

IIRC, the discount offer went up somewhere around November, with the "gold" version being released somewhere in January. So no. We had the vB3 reputation, promises and screenshots. No testbeds, open beta releases, or even a corporate version of the running platform to go by.

Actually, most people were forced to buy it before the beta. They got a "you get the whole package if you preorder now very cheaply" deal, and after like a week or so the amount you needed to pay for it was doubled / tripled or something. But as I said, we were buying it because of the good reputation of vB3 and the screenshots etc. they showed us (we had never seen the actual product yet) - which vBulletin looked little like unfortunately.

Agreed. Part of XenForo and Kier's defence was that they haven't caused IB's problems, and so I would expect evidence to be led on that from the private customer only area at some point before the conclusion of the case.

Private Members forum at vB has been sanitized, as you will not see any polls of people wanting to move to IPB or just sticking with 3.x.x series until something else comes again. This poll was prior to XenForo public existence and I can not find it, so I will assume it was removed / deleted. The same goes for all the negative comments in presales.

I really only found one thread about members wanting to go to IPB, and not the poll(s).

I didn't realize it had been sanitized. The rest is exactly what I was thinking. I was thinking it was showing an exodus before XenForo existed.

Those comments still exist in http://www.vbulletin.com/forum/forumdisplay.php/5-Site-Feedback before the move to the private board.

There was a growing exodus from vB long before XenForo ever came along.
The powers-that-be just don't want to admit to it. They'd rather blame it on the new kid in town.

Fufu the thread with poll is gone... I looked for over an hour for it in 'Customers Only Area' and was not able to locate it, but they left the thread members wanting to go to Xenforo. They were planing this since XenForo was in their screen of view.... Not the presales bit, as that was a disaster and most of the real negative comments were removed.

No the old threads are still accessible to the public.

But there are many threads in the Licensed Customers area, which is not accessible to the public, and tell even more of the story.

I thought that thread was fishy, asking where you would move to. I never voted, just in case.

You can find post before the public board went private.

Now you added to your story. lol. The other half is in the private boards, yes, I agree. Unfortunately, no judge can order abuse of customers if they are still coming back or their is a class act lawsuit against them. I do not think any judge wants to read all the posts we have read over the years with the limited time the courts have. This would be a job for someone else to bring certain points of interest presenting them to the judge in a slimmed down format.

I didn't add anything to my "story". I simply stated that there has indeed been an ongoing exodus from vB, long before XenForo came on the scene. Yes, some of it can be found on the public boards, but much of it is found in the members-only section.

That's all.

IPB gained a lot of vB customers long before XF came around. I remember these threads and I, too, was also considering IPB at the time.

I wanted to buy IPB a month ago, then I said forget it cause the staff would not let me download the 2.x series with a 3.x series license. They do not believe letting customers download archived products that are no longer supported. I know what I am doing, let me make my own decisions and then upgrade to latest with my own license when I want to.

Yeah, I agree with you on that. I didn't particularly care for their pricing structure at the time, so decided to stick with vB for a while until something changed. Well, something did change: XenForo was announced.

VB 4 "Gold" came out in December 2009 - http://www.vbulletin.com/forum/showthread.php/332171-vBulletin-Gold-Release?highlight=gold

The presale stuff seemed to come out on October 9th - http://www.vbulletin.com/forum/show...and-Important-License-Changes?highlight=order

As far as public forums go, you can always use the WayBack Machine at archive.org. If it was publicly accessible at some point, you might be able to find it unless they requested its removal or blocked the site from archives. It's slow, though. There also appears to be no data from 2011- I wonder if that is on purpose.
