I don't understand. So what does this all mean? There is still a trial in January? Basically, I just want to know if Xenforo is likely to still be around before I put anymore time into building a forum on their platform then get stuck with borked software.

Yes as Shamil says trial is Jan 15. Looks like that is confirmed. Judge doesnt want any more delays.
Plus the IB side have produced nothing solid. The whole exercise has been nothing but an expensive nasty game in trying to bully XF into collapse.
This hasn't succeeded. A few unpleasant and silly people have had their own kind of fun chucking hysterical rumours around but none of it has succeeded in pulling XF down.
So without anything substantial to face in court either IB will pull out at the last minute or XF will win. Either way XF will recover costs and the real work of XF can continue.

Upon XenForo's victory, I wish to hear / read the judges final order ending with the line "with prejudice"

Because otherwise, all I ever see Internet Brands Inc / vBulletin doing is filling appeal after appeal after appeal.

From what I gather (know) it has already been strategized :cry:

This is not true...people is quiet...waiting..

There is no reason to hate or abandon XF...
 
Very happy to see yesterday's ruling. It looks like the judge is just as sick of the delay tactics as we are. Win or lose, I'd just like an answer. Of course, I'm rooting for XF, and the moment all this nonsense is over I may just purchase another license to help KAM recoup costs. This is a great, unique, product that deserves to excel.

Keep it up Pam and everyone else involved!
 
@ Jake, just wanted to clarify in your current status thread it appears you have stated it was denied, but here it's only a proposed order and nothing was signed? Or am I missing something :D

The 15 Jan trial is the big one in the US - everything prior has been mostly formalities leading up to it. IANAL and dont pretend to be one - but this is the gist of it as far as I can work out. Take it with a pinch of salt until someone with the knowledge corrects or confirms my post.

From the sounds of things, the Judge got fed up with IB trying to delay the case by calling new witnesses and evidence last minute, so he's put a stop to it and basically said "no - you've had your chance to add evidence- time's up". He wants to get on with the case, which is what will start on Jan 15th.

No idea how long these kinds of cases last but I'd guess it will be a few weeks long at the very minimum - but again IANAL.

Scare tactics, delay tactics, call it what you will, I don't think vBulletin has provided a bit of evidence proving anything, even their own witness testified "against" them saying the code wasn't copied.

...Though the copy of the order that was posted in this thread isn't signed. I assume the proposed order was signed since it was drafted today. Still waiting for certainty on that though.

That's the general consensus.

Even Internet Brands' own independently hired experts have publicly admitted that there is no code exchange between vBulletin and XenForo, sighting that XenForo is it's own independent products.

At every other turn Internet Brands has tried to amend, extend, or otherwise delay this from going to court. The goal from the very beginning for Internet Brands would seem as though it was to cause damage and the idea of winning if possible (seemingly it's not) was only a "bonus" (if possible).

We can only interpret their actions as I highly doubt they'll ever come forward publicly and say;​

"Yes, XenForo is a better product and upon the time of it's release was far superior which vBulletin could not complete against and the long term goal was to "neutralize" a clear threat."

Of course as I said and as it is well documented... At every other turn Internet Brands has tried to amend, extend, or otherwise delay this from going to court.
