As the document cited, that is the jury trial date set. I quite honestly believe it was the only thing the judge could do with the claims being made about business bullying. IMHO, the absolute right decision. If IB try to wiggle out of this set hearing, then it will pretty much prove beyond reasonable doubt that IB have no tangible evidence and they are in fact doing exactly what has been depicted in relation to antitrust. They would bury themselves and open themselves in the same instance to millions of $$$ in lawsuits.

Note the plural of "lawsuits" as they not only went after XF as a company, they have gone after individuals under the same premise.

Effectively yes, IB and XF go to court and present all their evidence to a jury, who then deliberate the points and decide who wins :)

Very little. There is a possibility vB could request it be pushed back or make leave, but given the recent actions of the judge I think he has finally twigged onto what VB is doing and wouldn't allow it to be postponed any further.
 
I wouldn't be at all surprised to see them try and push it back even further

But I can't believe it won't be heard until January! wow.

Depends on many factors. One would hope XenForo wins and VB leave it there, however they can appeal under certain circumstances, but until we get to that bridge we won't know.

The time is given to allow both sides to formaise any evidence, any witnesses, finalise claims, arrange depositions etc etc without giving them the excuse "sorry sir, we didn't have enough time".

You can always appeal, not just under "certain circumstances" -- Based on IBs behavior to date, I would say its a virtual certainty if Xenforo wins that IB would appeal...

And for that to be granted I guess IB should have some type of substantial proof that it's worth going back to the case again? That's what would sound logical to me.
 
I haven't been following an awful lot of this - is the January hearing a new thing?

What happens in the meantime, does this potentially mean (aside from the obvious stress and anxiety caused by an impending trial, of course) that the pressure is off and some of the previous stress and financial burden is relieved?

As a general rule, you have to demonstrate that the trial court erred in some decision it made. Its not a 're-trial" - Regardless, appeals cost alot of money for the lawyers as well, sometimes more then the trial.

It was my understanding, if the judge dismisses the claims with prejudice in civil claims within the US that the proccess to have it overturned is particularly difficult and costly without any guarantees of success.

Though your right, I don't think it would stop VB trying...

The order was made on Friday, so yea, new :D


As for financial burden, not exactly. XF will have to pay for G+G to prepare the trial case... which in honesty will probably be the largest single cost to the in this case I guess due to the large ammount of hours required to prepare it...
