I also hope the same but it looks we will be served. So important thing is when that will happen actually. Because my lawyer wants to read those papers before advising me anything. So basically i am stuck and can't do anything until i get served.

IB always seems to deliver bad news at the worse possible time....and in the process rain on everyone's parade.

The fallout that they may well suffer if they start going after people other than Kier, Mike & Ashley could well cause them to think twice. Its one thing going after KMA & XF, but something else going after individuals that by all accounts have done absolutely nothing wrong. If they do and when its prooved they did nothing wrong, it may well cause quite a few of the remaining vB customers to think again, not to mention make investors question the wisdom of the vB board and the safety of their investment.

They really have nothing to gain by making it personal, their beef should be with XF Ltd, not other ex-employees in some hair brained 'hacking' conspiracy.

I feel sorry for like Mert who have been caught up in this mess & facing not insignificant costs having to defend themselves just because vB are throwing a tantrum I'd expect off my 3 day old.
 
Just reading through the amended order now - blimey, they don't hold back against Ashley do they 'wire fraud'?! Given that one of the depositions from someone in VB/IB (forget who now) stated that they don't have any server records from this, I can't wait to see what evidence they don't present.

Basically they appear to allege that KMA hacked into IB's servers to get confidential information and used it to promote XF via blogs, twitter and other media.

Didn't it occurr to IB that XF didn't need any of that? Kier & Mike's reputation within the online forum community is such that whatever they did next would attract attention?

My reading is as follows. IB are bricking it. They've seen the growth of XF over the last 12 months and the numbers of customers they have lost. They've simply thought "there is no way they did this without hacking our servers", just as they thought "there is no way they wrote XenForo in 12 months without copying our code".

The problem is the don't appear to have the intelligence to actually realise they did neither. Instead they're hell bent on piling legal pressure up on XF as more and more big vBulletin users switch over to XF.

However, what should be noted as well is the number that have switched to IB or other competitors simply down to the practises of IB.

IB won't go bust over this, they make too much elsewhere, but they do appear to have taken a best-of-breed software solution and for one reason or another simply screwed it completely.

IB know that VB is doomed if XF survives, which is why they're desperate enough to try this stupid 'hacking' claim.

I just can't wait to see what evidence they put forward for it.

Apple for providing the Macs that Kier & Mike wrote XenForo on...
Microsoft for the same reason.
Perhaps even Opera, Google, Mozilla for providing browsers that allow us to browse XenForo.

Don't forget the postman who delivers the XenForo mail, or the bank account that holds XenForo's money. Perhaps even PayPal for allowing XenForo to use them as a service :rolleyes:
 
If I were those guys outside the US, I wouldn't even bother responding... and make IB perform extradition proceedings to appear in court or force them to step outside the US into the country the person resides, and those courts, being the law they come under, not US law like IB's arrogance seems to think is global law with reach into any country they deem appropriate.
