California Case Update

I recall my Law professor on day one, lecture one, telling us that if you don't have a VERY sound grasp of English and a very nimble use of the language you will not make it through the course, nor in the Law at all.

It would certainly help while you interpret/read the laws in order to make your case, but I would like to think that simple would be better when you actually do make your plea.

Yes, I remember when this topic used to be about the lawsuit, rather than how to choose your words.

Ah well, at least I'm up to date again.
 
Hopefully tomorrow will be something we can all smile (or even better laugh at) afterwards. It sounds like team legal xF have their heads screwed on, and more worryingly for IB, we've yet to see them pull a single piece of evidence out the bag that they could use to justify their case.
 
Wasn't the hearing moved from Oct 3rd to the 17th? Or am I missing something?

Book better titled as "How to Convince the Judge's Clerk and Win Your Case." I have always been a fan of straight, simple talk, only using a specific word when there is a purpose or where another isn't adequately or just doesn't suffice. For a sophisticated crowd, sometimes choosing one more "accurate" synonym over another can make a subtle but important difference. But that doesn't excuse using a more complicated word that few are likely to know (which makes one sound pretentious.) You're better erring on the side of comprehension rather than hoping to score bonus points by adding unnecessary complexity.
IMHO, good for Shamil. So he derives some pleasure in covering this case and providing updates to other people who are grateful. Sometimes you don't need a reason other than that you enjoy being the one who is reporting the events. After all, millions of bloggers "waste" their time on far more trivial and useless matters while this one has a good purpose. Rock on, Shamil.

Peggy, you're not the first person to mention it so don't feel bad. I think it is because he is using a vB staff avatar and so a lot of people have assumed that he is an vB/IB employee in some of the threads.

Yes, that's right...I meant that something good comes from the filings. We won't know the outcome until the judge rules, but as we have seen from previous filings, a lot of good "nuggets" of information can come out from the briefs.
 
Oh, I haven't looked at the local rules, but many courts allow for filings through the E-case filing system until midnight on the due date. So, we may not see new documents posted for several hours yet.
