California Case Update

^^ The caveat being, of course, that you're not a legal expert and Mert may wish to consult one just to be sure!! ;)
Correct... and I would seek legal advice for the specific country of origin.

I have been down this road myself, and begun legal proceedings against individuals across borders, hence how I found out the end scope of it for civil matters. I had to employ council within that country and lodge within that country, then attend within that country, to take legal proceedings against a citizen of that country. European countries I am talking about here. First hand experience equated to... waste of time, effort and the financial cost would have been huge, for still zero return, as you cannot get something from someone that they don't have.

I should rephrase that... "they may file" whatever they want, but again, for civil proceedings, it will go nowhere and achieve nothing against individuals, unless they're US citizens.

This is why I suspect a previous quote by someone, about wording including "criminal" negligence, has been used, in an attempt to try and make it 'criminal' against the individuals vs. civil... as criminal will carry weight, civil means squat across borders.

In california DoC suits are lost with a 75% rate. And hard to proof.
That's because you have to actually prove that the comment made in that legal paper actually stopped someone from either purchasing your product or interacting with you. It's a very strict law :/

Following the comments claimed against Mert in the vbulletin case, I decided against hiring him.

:D

I honestly think that their case against us will go no where and hope judge will deny but i amno legal expert , have no idea about what Antony wrote. But i am so disturb right now. I am currently on vacation and found about the case yesterday morning via twitter on my phone. I will meet with a lawyer next week when i get back to istanbul. After then i can see future better.

Thing is this case aboute us is a shame. There are numerous claims against us and i hope that our names will be cleared as these claims can effect our future professional life.

It would appear that the main (only real) reason for involving Gordon, Frei, Gokceiman was to paint a picture that Xenforo was engaged in wire fraud and it engaged in criminal activity. The charge is ridiculous (as stated above).

Ridiculous Rico (Suave) !
/LOL.

Update: September 14, 2011 17:22 EST.
OK. I have sad news. I watched the Rico Suave video again. Worse, I don't know why I did it. It is such bad late 80s cheese. I'm not sure how the guy kept a straight face recording the song and the video as well.

Sorry, guys I just had to do it. Probably shows my age off, as well.
LOL.
I'm guessing age 15-20 in 1990ish. 40 ? :)

Yes, but they are doing that under the UK company... big difference, hence why they kept that just before it expired, as they obviously thought ahead as a "just in case" approach.

If they didn't have that UK company still registered, sueing across borders for individuals is extremely difficult.

VB vs. Xenforo is companies, not individuals... which is different.

Try and sue me for example, from the US to me in Australia... and let me just say, you would endup having to come to Australia, I wouldn't be going to the US... because the US have zero jurisdiction over me as an individual, thus I have no requirement to get on a plane and face a US court... it would have to be criminal and go through extradition processes in order to get me into the US court system... which they just don't do for civil matters.

Where is Mert? Turkey? Goodluck with that one IB!

Hence why I say... individuals shouldn't waste their time or money responding to IB / VB unless they come into their countries uniquely and file within that countries court system. They cannot file in the US against individuals who live in another country... it will go nowhere!

They tried to deregister the company, which shows that they may not have had the intention to sue initially. The case in the UK cites two defendants, both vBulletin Solutions Inc, and Jelsoft Enterprises Ltd.

Out of curiousity, are they actually sueing current or newly resigned staff? or are they just accusing them of wrong doings?

I can't believe a company can be so disrespectful to individuals and companies alike, it's a wonder this world is such a mess when massive companies like IB, exist.

I am not sure about Colin but Darren and me are not working for them over a year now.

Hey Paul you better watch your self. Your over here posting information that belongs to VBSI you will be next to be sued. If you work for them and it comes out of your mouth they own it. Seems they have copyrights on our minds.
