So there's a permission. "Ban users" set to never.
And they can still use the Spam cleaner to ban users?
I don't think this is right. Yes I can remove the Spam cleaner permission but there's a lot of useful tools in there I want them to have, just not banning users-
IMO the Spam clear should check if the user has permission to Ban user and if not then not show the option. Am I crazy?
 
Banning is really one of the primary use cases of the spam cleaner and, to be more accurate, by default, it doesn't allow you to ban everyone. It is limited in scope by default. There's separate criteria to control who can be spam cleaned and by default it's fairly recent users.

We do provide that as an option (you can turn off banning entirely via the spam cleaner) but generally not banning someone who has posted actual spam on your forum seems illogical to me.

So there'd be no plans to change this, it's very much as designed, and you will either have to accept that moderators with the spam cleaner permission can ban certain users, turn off banning entirely for all users of the spam cleaner, or if they can't be trusted for some reason (?) then maybe they shouldn't be moderators in the first place.
