California Case Update

I've read over the last few official updates and a lot of the discussion here, but still don't feel that I have a good grasp of exactly where XF stands. What, exactly, happens in October? Is there still any risk of the company being shut down?

  1. In addition, Darby and Sullivan convinced a
  2. variety of Plaintiff’s current and former employees, including Darren Gordon, Mert
  3. Gokciemam, and Colin Frei (the “Employees”) to breach Confidentiality
  4. Agreements and directly provide Darby, Sullivan and XenForo with Plaintiff’s trade
  5. secret information.
XENFORO LIMITED, a United )Kingdom entity; KIER DARBY, an )individual; MICHAEL SULLIVAN, )an individual; ASHLEY BUSBY, an )individual; DARREN GORDON, an )individual; COLIN FREI, an )individual; and MERT )GOKCEIMAM, an individual.

Here are the new defendants.

In addition, Gordon, Frei,Gokceimam, Machol, and Bingham misappropriated Plaintiff’s trade secrets byproviding access to them to Darby and Sullivan, knowing that Darby and Sullivanwere no longer Employees of Plaintiff and were using the information to create thecompeting XenForo program.

Obviously speculating...but if this was the reason Steve Machol and his wife left, with 2 others...I feel sorry for them all even more.

Shamil, you may wanna remove the double numbered bullets (marked in red above). Took me a while to figure out that it wasn't "4 agreements". ;)

Moreover, in addition to having VBSI Employees Gordon, Frei, Gokceimam, Machol and Bingham illegally help them access Plaintiff’s servers and trade secret materials, Darby and Sullivan themselves directly hacked into Plaintiff’s computers by relying on online channels and access routes that they had created while they were still employed at VBSI, which they knew they were not permitted access to use after they stopped working at VBSI.
 
Shamil, can I paste the actual text of Pamela's letter here? I found it to be a particularly interesting read...:D

I think you can post bits from it, not sure what the policy is on this.

Basically, VBSI's application for the hearing date to be brought forward was denied by the Judge, and he completely wrote over the proposed document- which I find funny.

I can never open those documents Shamil, can you post them in a different format or so they can just be read as is?
