It just goes to show you that IB is upset that they lost great devs, so instead of wishing them the best of luck because of all the hard work they did, they want to just beat them down as if they were never friends.

which in my opinion should be a criminal matter in and of itself and is a shameful act but aside that...
How the hell do you take someone to court and then refuse to testify...where is the case?

Personally I believe that the parent company of IB needs to take a deep look at this and realise the damage that IB Management is causing to themselves. They have seriously cocked up. There is only one outcome to this lawsuit, XF wins. Plus that they will claim back their costs and possibly countersue.

IB had a less-than-stellar reputation before they ever purchased vB/Jelsoft. I doubt that Bob Brisco really cares all that much about what this is doing to further sully their rep.

If I remember correctly from a few semesters ago, the Judge can be "convinced" that Joe R must testify in court if he believes he has (or should have) compelling evidence to support IB's claim. I know in criminal cases, if a witness for the prosecution refuses to testify, unless there is a compelling reason such as they are a diplomatic staff member or it would cause undue medical trauma, they can he held in contempt of court (= Jail Time and/or a fine). Defendants are immune from being forced to testify because of fifth amendment protections. I don't know, however, if this same ideology (forcing Joe to testify under oath) can happen in the context of a civil case.
Either way, doesn't look all that great for IB.

I just hope this latest evidence starts to squash any doubts in those who have held off changing to xenforo, that this entire thing has no merit and is only about corporate bullying.... Leave vb and install xf... You won't be sorry for the change... I'm not, nor are my users!
