User's score has to move past the threshold to trigger the action. Note, not be over. Move past. In your case (points threshold = 10) he would need to have been on 9 or less and go to 10 or more to cause a ban.
This record shows the user was already on 44 points (at least) on 23 May, and so cannot currently pass the threshold. It all therefore depends on
- when the new Warning Action was set up
- what the user's score already was when that happened.
