No they can't. It would be against consumer laws.Sure they can, if they work it into their license. However, it might not be very cost-effective to pursue every single person running pirated software.
I can also ask, what makes you sure that those who defend anti-piracy measures actually aren't pirates themselves, but act as if they were all for anti piracy only to blow suspicion away from themselves?
