XF 1.5 Paid Upgrades

Permanent are kicking in fine.
User selects monthly its not

There are no records at all for those purchases? Not even "unknown upgrade" entries? If that's the case, then PayPal isn't actually even calling the server for them. Do you see an IPN history in PayPal for any of those transactions? It should be accessible here: https://www.paypal.com/cgi-bin/webscr?cmd=_display-ipns-history

... but it shouldn't matter, since I believe XF sends the (override) IPN callback URL when it initiates the transaction?

log shows it being sent to my email for errors not my paypal account, yet it went to my paypal
permanent purchases show both emails
i removed the error notification email now
