The more I think about it the more I see this as damage control. There have to be a lot of important people (IB executives, directors and shareholders) asking the vBulletin management team why they are spiralling downward as IPB gains momentum, and why XenForo looms as the vBulletin killer when it could have been vBulletin leading the pack. The suit is a way of diverting attention, involving lots of laywers who will later get the blame when they lose this action, and perhaps smoothering XenForo before it is born if Team XenForo falters.

A "Hail Mary" strategy usually fails, especially against a strong defense. And it invokes the law of unintended consequences.
 
Sadly, the truth is XenForo Ltd will probably need to pull the launch tomorrow, so that they can attend to this "other" issue, regardless of how petty it may seem to most. What it has done (and we know this was not IB's intention) has raised awareness of XF and the awesome community that has developed over a relatively small timescale.

XF will survive - it's genuinely too good not to.

I'm starting to think the same. But it doesn't matter to me. I can wait to get my hands on a copy later.

I rather see them clear this issue and get it over with. In the mean time they can still finish the software to gold status.
 
Hmm, i'd be surprised if they did tbh. IB could file for an injunction, but i would imagine the guys would be business as usual until then.

Also, any C/D orders take time to be filed, as well as the legal time given to the defendant (90 days from the top of my head) to respond.

The problem here is that if XF sell huge ammounts of the licence then any sales would be effectively used against the company and if IB won XF would have to fork over the cash. (A good example, MDY vs Blizzard, in which Blizzard claims MDY owes them over 1 million dollars in sales)
 
We can goe on with this discussion till..... All we can do now is to sit back an wait for that what will happen.
Only one thing will be for sure. So or so. IB will loose a lot
 
IB have no leg to stand on, the UK courts will not be able to stop the sale of Xenforo in any capacity. They have not infringed on any copyrights, they merely left a Company and then decided to use their experience to build a new forum system. UK Law does not stop that, all these stupid "you cannot work for a competitor for several months etc" clauses written in contracts are worthless. I work for a gaming retailer and I know I can go work for a competitor tomorrow without any recourse on me or my employer. It is just scaremongering.

My final words, IB, I have used VB since version 2. The sooner I can get rid of you the better. You have shown your true colours.

It's not like XF have hugely expensive overheads to be covered at this point, and the value of the assets (e.g work done by kier and mike) would factor into any judgement also. Theres very little downside for the guys going ahead with this (the sale) if they feel (or receive strong advice) that they would win any court action.
 
This action could be something that is drawn out over a couple of years. I am not sure about the court system in the UK, but here in Canada those big legal wheels turn r-e-a-l-l-y slow.
 
xenForo is new. If IB stops them they won't be doing much to kier/mike as they can start over. IB on the other hand has gained bad reputation or the new company that has bought IB.

True, but lets say if something bad did happen. I'd hate to see Kier and Mike looked bad upon members.
Eg. we buy licenses and XF has to close down without refunds.

I doubt the guys want to put us in that position.

At the end of the day.. I say cancel the sale tomorrow. Get to the issue, and still work on XF to gold. By then the case will be at some finalized point. And XF will win even more members over, when everyone finds out IB failed
 
I was going to buy just the once license for testing/playing around with before upgrading my main forum. Now I'm getting 2 - I wanna get away from IB asap.

How far do non-compete causes fair in the UK? I know ones with no expiry are destroyed by the court.

When I last sold a business in the UK my legal advice stated the non-complete cause wasn't worth the paper it was written on, I had the same legal advice when I left my last employed position.
 
The good thing here is that XenForo is a UK-based company. International law doesn't work so quick. It might take months if not years before the lawsuit can be resolved. In my opinion, it is a last-ditch effort by IB to prevent XenForo from going live. First, IB wants to make XenForo look like a rogue entity. Second, they want to prevent XenForo from entering the market for as long as possible. Do you know how african wild dogs take down their prey? By running it down till it has no strength to keep fleeing. I think that's what IB is trying to do. What they have to lose? A few court ordered $$ millions for initiating a frivolous lawsuit?

I think Mike, Kier and Ashley need to carefully evaluate this situation. They are the only people who can compare the vB and XenForo codes right now. Consult with lawyers specializing in copyright infringement cases and proceed cautiously. Don't let the big dog bully you. Let us show our support for XenForo by buying your software.
 
I am so disgusted with internetbrands I have for the past 1 hour and a half removed all my resources from their domain. (something thought I'd never do) That's 113 threads, several hundred packs tens of thousands of images removed.

Probably makes me as bad as them but then I never really did care what others think.

It just shows you the lengths these clowns will stoop to. Not only that they cannot accept their responsibility since the takeover of IB that they messed up in every way they could. Thik about building a product from the ground up rather than trying to make an easy buck off the people you serve.
