Friday 25th November Update
Certificate of service.
On the 25th November 2011 the claim form and attached evidence, a copy of which is attached to this notice was served on defendant 1 by First Class post at (address) being the defendants college.
The date of service is therefore deemed to be the 28th November 2011

Notice of Issue
Your claim was issued on 16 November 2011. The court sent it to the defendant by first class post on 25/11/11 and it will be deemed served on 28/11/11. The defendants have until 12/12/11 to reply.
 
If they were unaware of such action, boy are they in for a shock! hehe
If they are the ones, and they are indeed guilty, then who cares?
I mean, they deliberately accessed a system unauthorized, and on top of that decided to cause damage to the site directly and because of their actions indirectly. Therefor they should be aware of the risks involved.

If we had pursued this as criminal matter, they would be looking at between 5 - 10 years in jail. (quoted from the policeman who took my original statements, 5 years for unauthorised access with intent to impair, and upto another 5 years for willful destruction of property / data)
Fortunately for them, we arn't taking this route.
 
Oh don't get me wrong. They should get a good shock and realize that their choices have consequences and these are moments in their life they're going to learn from. But it shouldn't be a real surprise for them, one guy took the idea of going too far a reality. The justice system will do its thing, you took action to get compensation for the damages caused. While it's inviting to ruin their complete life by going to criminal court, I am glad to see it's not what you're going after.

I would love to see their reactions apon opening said letters.;)
 
Perhaps not a response your lawyer desires you to answer, but .. Did you do that in an attempt to settle outside of court?

I am representing myself.

We tried to resolve the issue out of courts, they ignored us. so we are taking the matter via the courts system.
 
Best of luck, Slavik - If/When you win, hopefully it will give other hackers a thought that crime does not pay! :)
 
I'd be interested to see if the college/parents are aware. Can you imagine the heat?

Slavik - Did they access your system from their college network? I'm guessing not.

Just know that your chances are slim with this. Judges and juries themselves don't look upon self-representation as a good move, especially in a criminal case. One screw up, you're as good as jail bound, or lethal injection.

But I am hoping that you come out of this situation with an upper hand. I agree with others in that this is a great move you're making here.

He can represent himself pro-se right now, but it doesn't inhibit or prohibit him from retaining counsel should it escalate.

Bear in mind, this is a Civil case, not a criminal case - its different and in the early stages, you don't need legal representation anyway.

That's not what I was saying. What I was saying is - in the view of judges, or juries... They don't see it as a good move, so it looks bad on him. However, I do agree that he's not inhibited, or prohibited from seeking counsel should it escalate.
Bear in mind, this is a Civil case, not a criminal case - its different and in the early stages, you don't need legal representation anyway.
Whether it's a civil case or criminal one... That's not the point that I was making.
