Really interesting documents to read. I think the expert's view on whether the code for XF was copied (it wasn't) will put a lot of peoples' minds at rest.

I still can't get over vB suggesting they could outsource code writing to China to speed it up, purely because of the shareholders wanting/needing to see vB4 completed quickly. That's amazing really. I'm sure that is of course how many large firms now work, which is a little sad really.

It was also backwards compatible with, and allowed imports from, existing versions of vBulletin (including vBulletin 4.0)
Looks like Paul might get dragged into this case.

I have to admit I laughed when I read that. Outsourcing vBulletin development to China just seems ridiculous.

Anything is on the table if it's to make a quick buck for the share holders, sadly
Doesn't seem to matter how a product, or indeed the staff are treated, as long as there's money to be made.
 
But in a dispute about protected intellectual property rights, the relevant definition of "copying" also includes using someone else's creative expression of structure, sequence, or organization-critical elements of the design stage that underpins all software-as a model or a template from which to derive and implement code that may not be identical.

Seriously? Why aren't other forum softwares sued then since they are merely identical when it comes to " creative expression of structure" Funny guy.

For me,the first document I found petertaing to him was apt - detailing his costs.

$400 a day, rising to $800 if he's in court.

To be fair to Plantiff's expert witness, it is also called full and fair disclosure.

Sorry, to me he seems to be working awful cheap.
 
The rates have been posted incorrectly; they are per hour, not day.

My rate for consulting is $400 per hour. My rate for providing deposition and trial testimony is $800 per hour.
 
Reading the history is a good read. Interesting to see some of the decision making based on $$$ instead of the right thing to do. Glad they padded their pockets at VB early on because they are going to need to when they continue to bleed out over the next couple of years.

I am struck immediately that this guy is giving testimony on things he can have absolutely zero first hand knowledge of, nor would they fall within his expertise, for which he is supposedly giving testimony...​

Such as:​

  • The time frame of when the lads left Jelsoft, what was going through their minds at the time.
  • The conversations they had at or around that time.
  • The conjecture that they influenced vB employees, or gained information from them.
  • Psychology of developers and the Ethics thereof.
I hope the XF lawyers rip him a new one for this..Total tosh, the guy is a real mercenary obviously saying what has been handed to him to say.​

He also misses the point that VBSI never had a design specification for the real v 4.0 as there never WAS such a document other than the single page document that merely outlined the objectives for 4.0 Objectives btw that are common to all modern software products.. including Invision Power Board which went through the same total re-design slightly earlier.​
 
Conclusion:
Stated more starkly, the first few critical steps of the Systems Design Life Cycle-those involving Planning and Design-occurred only once before a single set of programmers undertook the Development stage, twice.

I see IB admits that Xenforo didn't copy vBulletin code.

So IB's big claim is that xF copied vBulletin's Planning and Design ?
That'll be near impossible to make stick.
