Considering I've never bought a used game, nor sold a game, the whole issue of second ownership isn't a problem for me.
If it's true regarding not owning the hardware and leasing it, that might be an issue for me. I guess I'll have to look into the legitimacy of that claim.

Prices vary for brand new games.. I've bought games for £40 only to shop elsewhere and see them being sold at like £36. How are Microsoft going to determine the price for the new game when even the retailers differ in prices?
Some games, FarCry 3 springs to mind, ship with an activation code to use multiplayer and require you to re-purchase an activation code to play that game online if you sell it. I figure this would be a much better approach than requiring someone to buy the game again.

I go to Gamestop at least once a week, twice every other week (when I get my son). I have never seen them "intentionally" have them marked higher. I have seen it where a used copy still had an old sticker, and a newer game has a newer sticker, but the new game was cheaper. Once asked, they simply looked in the computer and told me the updated prices. Keeping up with 1000 games and prices can get a bit hectic. They wouldn't be in business if that was common practice.

Not really. The exclusivity between M$ and Activision is around DLC. The multi-year contract was from MW2 to BO2, but that has been expanded. The re-newed, expanded contract means that any DLC that's released for Call of Duty from Xbox Reveal on - will be exclusive to Xbox-branded consoles. That means, the DLC packs will only be [timed] exclusive to Xbox 360 and Xbox One. So, as usual, PS3 and PS4 users will get DLC a whole month later than Xbox players.CoD will be on both consoles, however they have a contract of temporary exclusivity with Microsoft for the initial launch. If the game is that important to you it might be better to just wait it out and go for the console that is less restrictive and offers the better perks (looking like PS4 to me currently).
