However, you do bring up a good point .... Companies often want you (the consumer) to believe you have no rights or that you can willingly sign away all those rights without question or further debate. This of course isn't true.

isn't this a standard phrase in all US agreements? even vBulletin ( https://www.vbulletin.com/order/license_agreement.php ) Sun Microsystems Binary Code Agreement ( http://java.sun.com/products/javacomm/COMM3.0_license.txt but they DON'T disallow to create biological weapons!!) and several other includes this^^
