As designed Cookie notice is always being rendered for guests

If the cookie notice is enabled, the notice is always being rendered for guests - even if the notice has already been dismissed (and thush won't be displayed anyway).
This seems unnecessary overhead as it also causes notice.min.js to be included on every page for guests even though there might not be any notice at all.
 
This is roughly as designed. Most significantly, this is necessary for things like guest page caching.
