Is this violating adsense ToS or not?

Yes, you can't move AdSense ads with JavaScript (or any other way). But truthfully, you don't need to move them... AdSense "above the fold" is based on where on the page the ads are *rendered*, not where the JavaScript is in the source.

How do you get the most out of adsense? I'm trying to show Sports ads (particularly soccer) my forum is about soccer and the MLS but all I get is coupon ads and flower ads., It's very irritating. Makes me want to turn adsense off as this just looks tacky.
I've actually turned it off a few times.
Any suggestions?
I'm showing the ad on home page under top breadcrumb.

I am with you on this one. I had to turn mine off. The first two days i introduced adsense to my forum. I only made a penny - Don't laugh

I have a sports forum too. 20% of AdSense ads shown are sports related. Once google finds out more bout your site and or the people who visit it, more related ads will be shown.
