Legally, probably safe. But, you are asking because it is nagging at you, it seems. What is the Right Thing To Do? I have some color perception issues, and I would either pay someone to color a theme or use a default. It just wouldn't feel right to grab someone else's work.

Unfortunately, it would appear that the judge does not see a clear cut judgement as it is. "Settlement" meaning the parties need to compromise. I would suggest that the magistrate will report intransigence to the judge and give the judge further grounds for judgement. And I am talking wa-a-y...
