Resale of licenses

I noticed a post about transferring and reselling of licenses. Since I can't comment on that post, I made this thread.

Just as an FYI, the restriction on transferring or reselling licenses isn't enforceable in the EU. The European Court of Justice has specifically upheld the right of first sale on software.

I don't have a pony in this race, but something to keep in mind for those that it concerns.

Yeah well, good luck with that. IPB has even stopped reselling a license. Would be to costly to start a trial over that.
Xen uses the same possibility which vB does (or at least did in the past), give you a 1 time sell option if you bought it directly. Seems fair enough to me.

Or did you read anywhere that Xen would also stop the right for selling it 1 time?
