XF 1.5 Notice is visible to the excluded user groups

I am not sure if I am doing it wrong. I want to show a notice only to the registered+confirmed members. But the notice is visible to the unconfirmed members as well (not to the unregistered though).

Well, after further investigating on both XF 1.3 and 1.5, I think this is a bug and should be moved to bug report forum, if moderators kindly do.

Unconfirmed users receive the permissions from the unconfirmed group when browsing, but they are not considered members of that group for purposes of anything that requires user group membership.

You want your criteria to be based on user state.
