I'll just fan the flames here a bit:

The Department of Homeland Security has accidentally seized 84,000 innocent domains. This time, Immigration and Customs Enforcement accused the wrong domain of hosting child porn. Unfortunately, that didn't just shutter one blameless domain -- the knock-on effect killed all the other domains on its shared hosting service. In IT Blogwatch, bloggers ponder the implications for the return of COICA.

Accidentally? In other words, not only are they not doing the job for which the DHS was originally assembled, but they're incompetent at this one as well.

Aren't we all? The law has to be able to clearly define where that line is, or it doesn't exist and we are all in jeopardy.
A big problem is that the law is too slow to react to technology, so when something tech-related does happen, old laws are worked in to try and compensate but more often than not, it doesn't work out.

And that is unfortunate. Just close it. Don't try to define the law. Don't try to draw a line and work from within that. Just close it.
What good does that do?
 
Of course it might be just the fear of fear itself.
From time to time, we all get "poked" (think the Transatlantic term is a "prod"??) just to make sure we're being safe, alert and so on and so forth.
Never used to happen in the old days...then again there wasn't 24/7 news coverage. Gotta fill it with something, right?
 
Yes this is wrong, and yes I am totally against linking to copyrighted material. I will not allow it on my sites.

HOWEVER...... doesn't our Department of Homeland Security have anything better to do than stuff like this?? Like, maybe... securing our borders? Or catching terrorists?!?!

The title says "Man facing jail time for embedding video" did he just embed the video or link to it? See if they start doing this to people who put up youtube videos... I don't think that would be a good idea.

His lawyer needs only bring this up...

1996 Communications Decency Act, which says "no provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider."
