I would like to report a forum

Specifically a group of forums that have splintered into several other rogue communities but generally still enforcing the highly anti-neurodivergent policy of banning people for essentially "posting differently" than the usual, I have proof, and I consider this proof because I've given them an HOUR to respond and they have yet to come in to the appeal thread and try to challenge me on this

Also worth keeping in mind this is the same group of moderators that actively protected a verified pedophile by the name of Fuzzy Modem, over on Spacebattles, in case this isn't enough to convince you this group of websites is deeply in need of an investigation.

You missed the point of my reply. I don't think child molesters are funny. I think it's funny that you believe that we can do anything about how they use the software.

If the forum is doing something against the xenForo license terms you can report it to xenForo but I think that should be done via the contact form.

If it’s doing something illegal then report to the relevant authorities.

However it’s not exactly clear, from what you’ve provided here, what those infringements might be. I think you need to provide a bit more detail.

Seems to me that the pedophile in question here is both banned and in prison?

Any forum can revoke your access at any time for any reason they want. There is literally nothing you can do about it. Why would you want to be a member of a forum that has revoked your access for what you deem to be nefarious reasons anyway?

1. Assuming your from the US, and the platform also resides in the US, someone banning you from their platform is not illegal. Platform owners decide who they want on their platform and what you're allowed to talk about. "Free speech" doesn't apply on private property or in this a case private platform. Owners can ask you to leave or "ban" you for literally any reason that isn't regarding a legally protected class.

I don't know about other countries laws, but assuming it's generally the same.

Except the Licence Agreement says:

You undertake to ensure that the Software is not used by You or others to engage in or promote: illegal activity; any activity that would violate the rights of third parties; defamation, discrimination, harassment, hatred or harm of third parties.

That part of the agreement has been discussed before. It's basically unenforceable.
XF can lock your account from upgrades or posting but cannot force you to uninstall the software.

But it does mean they can revoke the licence. Whether they enforce it is up to them. It's a fairly standard clause we used to call droits moraux (moral rights). Its reasons may be (and often are)n way beyond what is practically enforceable.

I'm aware that XF has clauses in their licensing agreement regarding illegal activity to protect themselves.

Let's run two scenarios:
1. Someone is banned from an XF forum by an administrator. That user claims they were banned due to illegal discrimination. Which they probably can't prove unless the administrator outright said it. I don't think XenForo Ltd is going to waste it's time dealing with this type of issue.

2. A site conducting illegal activity such as drug trafficking or illegal pornography. I'm not gonna pretend to know what XenForo Ltd does in these cases, but most likely all they can really do is revoke the license and refer the website to law enforcement. This doesn't actually accomplish anything until law enforcement does what they do (if they do anything at all). And tbh, any site conducting illegal activity probably wouldn't even buy a license in the first place.

I can't say whether they banned you unfairly or not without the full picture* so I won't pass judgement either way, but as others have said here, a private forum isn't a place for free speech in the way that you think it is and unfortunately, this absolute power allows the mods and admins to be little Hitlers if they want to be and do what they want with you. It's the biggest reason that I started my own forum as I was beyond sick of the abuse that I could do nothing about. I have peace of mind on my forum and it's glorious! On top of this, I'm proud to say that I'm good to my members and never abuse my power. Sanctions are only ever applied if absolutely necessary.

If you truly believe that these sites harbour pedos and other criminals, then do talk to the police about it. Unfortunately, without some sort of hard evidence, they're highly unlikely to begin an investigation. However, I still think it's worth having a chat with them on a non-emergency number or a police station if you feel strongly about this to at least get their perspective and advice. The only option you have if the police won't do anything is to simply walk away from all those sites as they're untouchable.

Not sure what you are expecting the xenforo team to do here. They arent responsible for how their software is moderated on other sites. Besides, they already allow a developer convicted of child p0rn activities to sell his services on here.
