Sorry for such introduction, but that's what I would like to know... There is a forum that I am interested in getting but the only things that makes me think about if is worth getting is that. Most of the members are old guys who once in a while create thread with naked pics of girls, including gifs and memes. Is there such a hosting that would allow that ?

I've managed a few bdsm related forums for people in the past, we always went with offshore hosting, usually the type of hosts that don't give a damn about legal issues and will ignore takedown notices. I'd advise you do the same for this type of site.

Unless you/the users own the copyright to the pics or distribution rights (I'm guessing they don't) there shouldn't be any host with servers in the US that will host you. If they do, shame on them. The issue with most adult forums is that people start posting pro pics, copyrighted pics, etc., and that's not good.

Offshore would most definitely be the way to go, as Dakota Storm mentioned. That way you don't really have to worry about it.

The board is not an adult porn board, its a regular board where members talk about the current climate in the country, breaking news, jokes, etc... but once in a while, a few of the granpa, get freaky and starts posting stuff like that

That's kinda what I figured by how you described it, but that still doesn't relieve you (or your host) of complying with copyright. Doesn't matter if it's one pic or one thousand. There is very little porn/adult pics out there that aren't copyrighted by somebody. Just have to be careful...that's all I'm saying. If you go with an offshore host, you should never have to worry about any of it, because they don't care about copyright, DMCA, etc.

That's why I find it really funny, all the hosts saying they would allow that material. I'm not sure they understand that knowingly hosting that material voids their Safe Harbor protections under § 512(c), and opens them up to all sorts of liability. That's why hosts need to tread carefully when it comes to adult material.

This is true however, if the video is embedded it's not considered a dmca issue. Not what we have been told by our lawyers anyways

I understand but I've been doing this for about 10 years and never had an issue with embedded content. But I understand where you come from
