I think it's laughable, the thought that Internet Brands are sneakily following Kier around taking screen-shot of what he says on the web. When they should be fixing bugs in vB4.

It sounds like a right old doodle working for IB. All you need for a job position is a screen-shot program. :LOL:

They are getting Paid for it to stalk him & prtscn everything from his updates :ROFLMAO:

IB is trying to suggest that because vB4 is OO + PHP + MVC ... and so is Xenforo ... that constitutes Xenforo stealing trade secrets from vB. I'm not a coder and I know all PHP scripts are migrating towards OO + MVC. If I heard that XF was not OO + MVC I would have questioned it.

exactly What IP was alleged to be stolen ?

Correct me if I'm wrong... Kier listed his last days of employment as June 8th, 2009 in his letter of recommendation (*Checks: Yes*). Adrian quotes two Twitter updates (direct quote here) that state (as accessed on these dates in 2009):
"Integrating some modern code into vintage 2003 javascript. Excuse me while I tear my eyes out." 18 May (02:13)
"Glorious sunshine outside, what a day to be glued to a text editor staring at curly braces." 21 May (00:24)

I have a few things to say about this:
  1. I just pulled up a calendar of May 2009. Those dates occured on a Tuesday and a Friday respectively.
  2. Both occurred during the work day (assuming the times were in fact listed in California's time zone; as LA is 8 hours behind London. 02:13 -> 10:13AM for Kier, etc.)
  3. Both occurred while Kier was still employed by vBSI.
How can these two tweets be used at all against Kier and/or XenForo. Neither indicate to me that he was working on XenForo, both indicate to me that he was doing his job.

Because the dates of the tweets (May) are in 2010, not 2009.... are they not?

This is getting even more embarrassing for IB/Adrian.

Direct quote from him states this:
6. Attached hereto as Exhibit B is a true and accurate copy of a "Tweet" (internet posting made via the Twitter.com program and website) posted by Kier Darby on Twitter.com, which I personally located and printed on or about the date indicated (May 21, 2009) demonstrating he was developing software during the period within one year from the date of his termination.

Again, providing my sanity Kier states:
My final day of employment shall be Monday, June 8th, 2009.

May 2009 is not within a year of his termination, its before his termination began. Proving nothing.
 
Yep, I just checked, they certainly are claimed to have been accessed on 2009. Heh...
Oopps...someone just made an oopsie trying to prove Kier was working on XF within 1 year of leaving VB while the date in fact shows he was still at IB working for IB?

I didn't understand the half of the legal language and the rest of many lines about programming either. But what I understand to give examples like video embedding, using a univeral languagel like PHP and try prove the similarity (and claim XenForo copied those from vBulletin) between the sofwares are ridiculous. What next, putting other forum softwares like IP Board, SMF, myBB, phpBB on trial?
 
I believe the tweets were actually posted in 2010 but that they mistyped it as 2009 in the statement.

Edit: Yep, confirmed by Kier (see above).

Yeah, fixing bugs and developing software kinda requires these silly things like coding experience, ingenuity, creativity. That's actually not required to make money though. You just have to buy things and then put ads on them and then buy the thing that makes the ads show and then tweak it a bit and resell it to anyone who you can persuade to trust you. (y)
