There's really no "danger" of losing XF. Even if by some odd cataclysmic event were to happen, you'd still have a pretty damn good, stable framework to build on and a multitude of developers standing behind it. XenForo was made for this generation, and will probably last a good 5 years before it could start to be thought of as old. :)

100%? Never. Their plane might crash above the Ocean when they get back from vacation, or a giant worm might eat them whole... :)

People can sue you for just about anything. Waiting for these to be over, in my opinion is just a waste of time. In 3 months, someone might sue xF for using this shade of blue. Will that stop you from ever using this engine?

thats not enough for the long term as you just described every free forum script. if i wanted that i would have gone for mybb but i am looking for long term support

There is no FREE script out there that is as powerful and put-together as XenForo. I don't really know if any PAID forum software that is (perhaps IPB comes closest?). The foundation is very, very strong.

If you wish to wait, fine, but I'm going to get my community going right away and not wait around for "what ifs." :) Especially when IB doesn't really have a case, and even if this case gets dismissed, there's still quite a while before the other one gets dealt with. Are you really going to wait that long?

Actually, since IB is arguing the technical aspect of it (after all, they claim vB is hidden somewhere in XF code), it's not too far fetched. ;)

I'm sure XenForo and its representatives are providing a clear explanation for what they are doing, why IB's claims are silly, and breaking it down so that those who don't completely get computer-related things can understand the situation better.

At the end of the day, the choice is really up to you. But there's hundreds of us (or has it hit thousands yet?) that already made a choice to use XenForo, and are doing so or are in the process of it. I highly doubt that if Kier and Mike were unsure of how things would go they wouldn't have released XenForo when they did, especially when the lawsuit was announced the day before the sale began.

We're confident that the lawsuits will pass into an amusing memory. :)

No one is able to tell you the result of the case/s yet, therefore no one can tell you whether there is a greater or lesser risk associated with buying an xF license than there is with any other software.

There are no guarantees with buying any software license that the company will continue developing such software, or indeed, will still be trading at any given point in the future. Granted, you may feel there is substantially less risk associate with investing in a license from a long-established large-sized software house, but you can never eradicate the risk entirely.

My personal understanding is that IB brought these claims, not for substantiated wrongdoings but for spurious reasons in the hope of intimidating the xF company into halting the release of their (directly competitve) software.

The tactic didn't work but IB appear to be wanting to continue anyway (I assume because they are large enough to absorb the legal costs and they wish to continue to disrupt the xF operation) - however one would hope that once the issue gets to court and the respective expert opinions are put forward, the hammer will fall in xF's favour (I don't have any reason to doubt xF when they say their code is entirely home-grown and there is no real case to answer).

I suppose the best way to look at it is this; is xF currently worth $140 to you? If you don't feel it is, just hold off until it has what you need and is worth $140 to you. That way if a court judgement falls in IB's favour and xF has to stop development, you've not lost anything (you either won't have spent $140, or you'll have a product you feel is worth the money!!).
